Home Buyers Seek Class Action Against Ryan Homes’ Tall Pines

A couple who bought a new home from Ryan Homes at Tall Pines at Grande Park development in Plainfield is seeking class action certification in their lawsuit claiming the builder secretly substituted inferior cabinetry and undersized water supply pipes and HVAC equipment during construction of the house. The case, Smith v. NVR, Inc. 17 C 8328 before Judge Feinerman in the Northern District of Illinois, seeks damages under the Illinois Consumer Fraud Act and for breach of contract, alleging that the equipment and cabinetry were cheapened from what was specified in the builder’s plans and specifications and the advertisements and brochures for the development.
